I hired American Tax Service (“ATS”) or another entity now under receivership control to prepare my tax returns, which I understand are due by October 15, 2025. Will my returns be submitted by October 15, 2025?

Neither the Receiver nor his staff can provide tax preparation services to affected ATS customers.  Of course, the Receiver is sensitive to customer concerns regarding unperformed or incomplete services by ATS and its affiliated entities.  Customers who may have been affected by unperformed or incomplete ATS services are encouraged to report their concerns to the Receiver.  While the Receiver cannot provide legal or tax advice, he strongly encourages all affected consumers to consult with legal or tax professionals of their choice.

What is the current status of the receivership?

The US Federal District Court issued a preliminary injunction on November 20, 2025. A copy of this document is on this website. The Receiver was converted from a temporary to a permanent receiver, and the Receiver has suspended all business operations of the Receivership Entities as the Receiver determined that such operations could not be continued in a legal and profitable manner. The company will not reopen.

As a consumer or trade creditor, may I sue ATS or any of its affiliates?

No, there is a stay on all litigation by 3rd parties.

Is ATS providing tax services?

No, if you are a consumer that needs tax services, you will need to retain a new tax professional.

Has a formal claims procedure been established?

No, a claims procedure has not been established. If consumers, employees or trade creditors subscribe to the case, their contact information will be captured by the Receiver’s office. Subscription does not constitute a formal claim.

Is ATS still open?

No, the company has been permanently shut down, and it is no longer in operation.

Is ATS still providing tax consulting services?

No, the company is no longer open, it has no employees, and its operations have ceased.

What should I do about my ongoing tax needs?

If consumers still have ongoing tax needs, retention of a new CPA or tax advisor will be required.

Will I get a refund?

It is not known if refunds or any consumer distributions will be made in this case.

Do I need to submit a formal claim with the Receiver’s office?

No, a claims process has not been initiated. Subscribing to the case will ensure that the Receiver’s office has consumers’ contact information.

Can I get a copy of my tax documents?

No. Consumers’ tax files/records are not available for retrieval.
